Introduction
In the event of a crime, the victim has a number of options available to protect their rights and seek justice. These options are outlined in the Turkish Penal Code and the Criminal Procedure Code.
Victim's Rights under the Turkish Penal Code
The Turkish Penal Code regulates the victim's right to file a complaint. Accordingly, the victim has the right to file a complaint about the crime. The complaint can be made verbally or in writing, usually to the police or the prosecutor's office. The statute of limitations for filing a complaint varies depending on the type of crime. A person who wishes to file a complaint about a crime may also do so through a lawyer.
The Turkish Penal Code also regulates the victim's right to compensation. Accordingly, the victim has the right to compensation for material and non-material damages suffered as a result of the crime. A claim for damages can be filed together with or separately from a criminal case.
Victim's Rights under the Criminal Procedure Code
The Criminal Procedure Code also regulates the rights of victims. Some of these rights are:
-
Right to File a Case: If a public case is not filed or the filed case is dropped due to the crime, the victim has the right to file a private case.
-
Right to Intervene: The victim has the right to intervene at every stage of the criminal proceedings. This right allows the victim to examine the case file, request evidence, have witnesses and experts heard, and present a defense.
-
Right to Claim Compensation: The victim has the right to claim compensation in the criminal case. This claim is decided at the end of the criminal case.
-
Right to Protection: The victim has the right to protective measures if there is a risk of being threatened or subjected to violence by the accused or suspect. Examples of these measures include protection by law enforcement or requiring the accused or suspect to maintain a certain distance.
Conclusion
Victims of crime can avail themselves of the remedies provided in the Turkish Penal Code and the Criminal Procedure Code to protect their rights and seek justice. It is important for victims to be aware of these rights and to exercise them.
